Forces of Nature and Extreme Weather

Although all Tuuci marine grade parasols, pergolas, cabanas, furniture and accessories are rigorously tested to withstand incredible forces of nature, Tuuci does not recommend or warrant the deployment or use of any collapsible shade equipment in wind conditions which exceed the following: 

• 25 MPH for Ocean Master MAX, Ocean Master M1, Bay Master collections.
• 45 MPH for the Ocean Master MEGA MAX and MAX F-1, when used with a Tuuci in-ground anchoring system. 
• Up to 100 MPH for Tuuci Solanox, depending on configuration. 

In extreme weather events, such as hurricanes or severe winter weather, Tuuci recommends storing product indoors whenever possible. Always store parasols in their upright position. It is recommended to remove fabrics first and store them separately to protect them from damage. If available, use a Tuuci protective cover. 

Wind is extremely variable and subject to site specific conditions such as proximity to ocean, mountains, or permanent structures. Other site conditions include products installed on high elevations or near physical elements that funnel wind and objects. Tuuci does not cover wind-related damages. Tuuci will only warranty products which are properly secured to an adequate anchor or anchoring system specified by a certified Tuuci dealer or sales rep. 

Furthermore, Tuuci will not cover any damage to any Tuuci product which occurs as a result of contact with the ground or any other foreign object. In general, Tuuci recommends that all collapsible shade products be securely closed when not in use, especially during inclement weather conditions or at night. 

Finishes

If a Tuuci applied powder coat or Aluma-TEAK^™ finish on frames, structures or anchors flakes, bubbles, peels, or loses color within five (5) years from the date of purchase, Tuuci will replace at its own discretion. This warranty does not cover any type of scratches or abrasions to finishes caused by physical contact (i.e., from tabletops or storage) or any corrosion that results from scratches or abrasions. 

Corrosion resulting from environmental conditions, including salt spray, chlorides, industrial pollution, standing water, improper drainage, or lack of maintenance, is not considered a manufacturing defect.  

For seaside and indoor pool use, salt and chlorides can accumulate on the powder coat and Aluma-TEAK^™ finishes, leading to finish failure outside warranty coverage.  

Failure to perform regular cleanings with fresh water may cause the finish to blister, oxidize, and/or discolor, voiding this limited warranty.  

All stainless-steel hardware and components are rust resistant but not rust proof. Proper cleaning of your product is required to keep your product looking new. 

Shade Anchors

Warranty covers manufacturing defects of structural integrity. It does not cover breakage, chipping, crumbling concrete, or finish abrasions due to contact with other objects, improper use or issues caused by onsite transit or other wear and tear. 

Electrical Components

Optional LED lighting, heaters, and automation components are warranted for one (1) year from the date of purchase against manufacturing defects in materials and workmanship to the original purchaser of the product. This warranty does not apply to damage resulting from accident, misuse, tampering, modification, negligence, or abuse. Tuuci will, at its discretion, replace components if found defective. 

Improper Use and Misuse

Products must be used only for their intended purpose and in accordance with Tuuci’s installation, operation, care, and maintenance guidelines. Damage resulting from improper use, misuse, neglect, or failure to follow recommended instructions is not covered under this limited warranty. 

Examples of improper use include, but are not limited to: 

• Failure to properly secure products to a suitable anchoring system. 
• Use of Tuuci products in wind conditions exceeding Tuuci’s recommended limits. 
• Failure to close, secure, or store collapsible Tuuci products during inclement weather or when not in use. 
• Dragging, dropping, tipping, or otherwise subjecting products to impact or abuse. 
• Standing, climbing, swinging, or hanging from any frame, structure, parasol, cabana, pergola, furniture, or accessory. 
• Use of products with missing, damaged, or improperly installed components. 
• Improper handling, transportation, storage, or installation. 
• Alteration, modification, refinishing, drilling, welding, or repair by anyone other than Tuuci or an authorized service provider. 
• Exposure to chemicals, abrasives, solvents, pressure washing, or cleaning methods not approved by Tuuci. 
• Staining or damage caused by lotions, oils, pool chemicals, floor-cleaning products, or other harsh chemicals. 
• Failure to perform routine cleaning and maintenance as outlined in Tuuci Care & Maintenance Guidelines. 
• Damage caused by commercial equipment, forklifts, landscaping tools, construction activities, or other external forces. 

Any damage determined by Tuuci to result from improper use, misuse, neglect, accident, unauthorized modification, improper installation, or inadequate maintenance is not considered a manufacturing defect and is therefore excluded from warranty coverage. 

Additional Exclusions

The following are not considered manufacturing defects and are excluded from warranty coverage: 

• Customer’s Own Material (COM). 
• Normal wear and tear, including weathering, fading, discoloration, chips, scratches, fabric stretching, or fabric tearing. 
• Damage occurring during freight shipment or handling. Responsibility for freight damage transfers to the carrier at the time of shipment. 
• Damage caused by the product striking the ground or other objects. 

Warranty Claim Process for Structures

If warrantable damage occurs, Tuuci will, at its sole discretion, repair or replace the affected item. 

Superficial damage, including scratches, abrasions, or cosmetic wear resulting from contact with moving components, the frame itself, or textile materials during normal operation, is not eligible for warranty coverage unless such damage compromises the structural integrity of the product. 

To remain eligible for warranty coverage, products must be properly cared for and maintained in accordance with Tuuci guidelines. Any modification or alteration performed by the customer or a third party voids this warranty. 

General Limitations

The redeemable value of all warranties is prorated over the term of the applicable limited warranty. 

The warranty claimant is responsible for all shipping and freight charges incurred by either the claimant or Tuuci in connection with a warranty claim. Labor costs associated with the installation, removal, or replacement of warranty-covered parts are not included. 

All warranty claims must be submitted with: 

• Original proof of purchase from the dealer of origin. 
• A description of the damage, including how the damage occurred. 
• Photographs documenting the claimed damage. 

These warranties are non-transferable and apply only to the original purchaser. 

Tuuci reserves the sole right to repair, replace, redesign, or otherwise resolve any warranty claim. Tuuci also reserves the right to improve products and modify designs over time. As a result, replacement parts or components for discontinued or older product designs may not be available under warranty or for separate purchase.
